PRACTICE AREAS
PERSONAL INJURY
Banks Weaver is a catastrophic personal injury and wrongful death trial firm in Atlanta. From the first call, we listen, explain your options, and we stand with you through every step of the process.

Evidence doesn't wait, so neither do we. We preserve it immediately and spend whatever it takes to uncover the truth: private investigators, accident reconstructionists, industry and medical experts, jury consultants, focus groups, trial presentation specialists. Our money, not a loan against your recovery — and if we lose, you owe us nothing.

Then we tell your story. That is the practical reason we build every case for trial from the first week: an insurance company prices a claim by what it believes a jury will do — which means it is really pricing whether your lawyers can make twelve people believe you. Gabe Banks and Sam Weaver have tried more than 60 jury trials to verdict, including catastrophic injury cases and serious felonies. They have won big ones and lost big ones. Finally, you should not have to explain yourself twice. We are small by design: the lawyer who takes your call is the lawyer who tries your case.

For the Cases That Change Everything
You don’t pay unless we win.
wrongful death
Wrongful death occurs when a life is taken without legal justification. No amount of money can replace human life. However, there are two distinct types of claims a party can file after a wrongful death in Georgia:
“Full value of life” O.C.G.A. §51-4-1 permits recovery for “the full value of the life of the decedent without deducting for any of the necessary or personal expenses of the decedent had he lived.”
Economic Loss: These losses include the income the victim would have earned, including potential raises, had his or her life not been cut short, as well as the value of services provided around the house (such as cooking, home maintenance, child care, etc.)

Non-Economic Losses: There is no true formula for the measurement of non-economic losses in Georgia. Georgia judges instruct juries to measure non-economic losses from the standpoint of what the victim lost by not living a full life. For example, what does it mean to lose the ability to spend time with your family, watch your loved ones grow up, enjoy hobbies, etc.
Estate claim. The estate of the deceased may claim damages for the financial cost of the accident. These may include funeral expenses and medical bills prior to death. In addition, the estate claim includes pain and suffering that the victim experienced prior to death.
SERIOUS & CATASTROPHIC INJUry
BRAIN & SPINAL CORD INJURIES
Brain and spinal cord injuries often result in permanent, life-changing limitations. These cases require careful preparation and long-term perspective focused on both immediate needs and future impact. We work closely with clients and experts to understand the full scope of treatment and support required.

Burn injuries can result in permanent scarring, lengthy medical treatment, and lasting emotional impact. Whether caused by a fire, chemical exposure, or defective product, these cases demand thorough investigation and compassionate, experienced advocacy focused on your full recovery.

Accidents involving commercial trucks are often complex and high-stakes. We investigate thoroughly, understand the regulations involved, and pursue responsible parties with disciplined, trial-ready advocacy.
RIDESHARE ACCIDENTS
Rideshare crashes can involve layered insurance and legal questions. We help clients make sense of their options and advocate for fair outcomes in an often confusing process.
PREMISES LIABILITY
UNSAFE PROPERTY CONDITIONS
Property owners have a responsibility to maintain safe environments. When hazardous conditions such as poor lighting, uneven surfaces, or inadequate maintenance lead to serious injury, we investigate carefully to establish accountability and pursue the compensation you deserve.
DEFECTIVE CONSTRUCTION
Structural failures caused by faulty construction can result in devastating, life-altering injuries. We pursue claims involving negligent design, substandard building practices, and failed inspections with focused investigation and trial-ready advocacy.
FAILED RAILING
A broken or improperly installed railing can turn an ordinary moment into a life-changing fall. We hold property owners and contractors accountable when defective railings cause serious injury — investigating the failure thoroughly and advocating for full compensation.
FAULTY WELDING
Faulty welds in structural components, equipment, or fixtures can fail without warning and cause catastrophic harm. We handle these technically complex cases with the investigative rigor and expert resources they require.
SLIPS & FALLS
Slip and fall injuries are often more serious than they appear. When negligent property maintenance or unsafe conditions cause a fall, we help clients understand their rights and pursue fair accountability from those responsible.
SECTION 1983 Claims
Officer involved shootings or deaths
When law enforcement use of force results in serious injury or death, victims and their families deserve answers and accountability. We handle Section 1983 civil rights claims with care, discretion, and a deep commitment to justice for those affected.

A wrongful arrest can upend your life, your reputation, and your future. When law enforcement violates your constitutional rights, we provide clear guidance and strategic advocacy to help you pursue the accountability and compensation you deserve.
